Oklahoma Land Access Laws

    Public Land Access

    • The public has certain rights to access private and public property. Oklahoma law defines public roads as entrances and exits used by general public vehicle traffic allowing the government access to repair and regulate private roadways commonly used by the public. Oklahoma encourages landowners to make private land available for public recreational purposes by limiting the liability of landowners when they allow recreational access to their property.

    Commercial Land Access

    • Commercial access to properties include such things as owning mineral rights to private property, how bankruptcies are handled by banks and how renters access properties when they have tenants. Tenants in possession of a property with the assent of the owner have full access to the property but the law also defines when a property owner can enter the property. Other land access laws set standards that limit the use of public land by commercial businesses.

    Easements

    • Right of eminent domain and easements for public and private use are Oklahoma land access laws that reserve the right to set apart land for public use. Oklahoma land access laws allows the state to declare and condemn or take some portion of private property for commercial uses that benefit the public such as building railroads, schools, public buildings, roads and utility systems.
