California Law on Maternity Stays
- Insurance companies must provide women with a 48-hour hospital stay following the vaginal birth of a child. This is not only a state law but a federal law signed by President Clinton in 1996. It's known as the Health Insurance Portability and Accountability Act (HIPAA).
- Women who undergo a caesarean section are required by law to stay in the hospital for 72 hours following the birth of a child. Insurance companies are required to cover this stay.
- California law requires insurance companies to provide an obstetrician and gynecologist as the primary care provider for a pregnant woman. Women do not need to request special permission from their insurance company for this type of care.
