How do I File a Mechanic and Materialmens Lien in Kentucky?

    • 1). Provide notice to the owner. In the notice, write that you intend to hold the property liable for payment and include the amount of the lien. Generally, this notice must be delivered within 75 days after the last item of material; laborers may have up to 120 days to deliver the notice if the property is commercial property and the amount of the lien exceeds $1,000 (as of August, 2010).

    • 2). File a lien statement which provides a record of the work performed and an accounting of the amount due with the county clerk's office located in the Kentucky county where the work was performed. This notice must contain every detail about the work (including property description and the owner's name and address). Deliver this notice within six months after completing the work.

    • 3). Send a copy of the lien statement to the owner. This must be done within one week (seven days) after filing the statement with the county clerk. DKLaw.com suggests sending it via certified mail.

    • 4). Collect on the lien by initiating a lawsuit. In your petition, include all the facts that support your right to payment (including explanations and documentation on how you followed the Kentucky lien procedure). Name as defendants the owners of the property. You must file this lawsuit within 12 months after sending a statement of the lien.
