Can I Apply for Legal Residency If I Have a Warrant?

    Immigration

    • An outstanding criminal warrant will block you from attaining legal residence in the United States. You can submit an application but the U.S. Citizens and Immigration Services (USCIS) will conduct a thorough background check and your warrant will show up and your application denied. This could possibly lead to your arrest as well.

    State to State

    • An outstanding warrant may prevent you from setting up legal residence in one state from another state. If you are an American citizen and move to another state, when you apply for residency, the new state may check your background against a national criminal database. Your warrant may show up and your application be denied.

    Warrants

    • It is possible to slip through the legal cracks, but it is unlikely. The only sure method to make sure your application is not rejected is to contact the law enforcement agency that issued the warrant and resolve it.
