Child Daycare - If A Parent Stops Paying It What Can Be Done?

Child Daycare is one of those items that ex's hate to pay. If they are capable of watching them at the time they
sometimes look at it like they are forced to pay someone to keep their child from them. They may also feel that they are paying child support which should cover it. No matter what the disagreement, the outcome is that it is often the case that ex's may stop paying their share of Daycare.

Child Daycare is a right that working parents have. It is typically a 50/50 split. The thought is that both parents have equal access to it and they both have a right to work. This is a separate agreement from Child Support.

Anytime a parent stops or threatens to stop paying court ordered daycare this can be used as grounds to file a new motion. The motion you would want to file would be a wage assignment. Most Judges are willing to issue these as they don't constitute a change but are simply a way to enforce an existing order. In fact it is a right.

Once you have a wage assignment order in hand, you can send it to the employer (there are instructions they must follow). Once the employer has it they are responsible to make sure it is paid. If they don't get it paid, then they become liable for the unpaid amount.

In addition to the wage assignment you will probably want to contact your local version of Child Support Services and open a case with them. They then take over collection for you and you no longer need to worry about having that discussion.

So the next time your ex threatens to stop paying daycare, send them a confirmation of the conversation in email. Then you can use that as documentation for filing your new motion.
