Pennsylvania Eviction Law
- If a tenant fails to pay rent or breaks terms of the lease agreement, she may be evicted. Also, if the duration of the lease expires and the landlord wishes to use the space for another purpose, he may force a tenant to move out. You may not be evicted because of race, nationality, religion, age or sex. You may not be evicted due to disability or because a tenant is a parent or pregnant.
- To evict a tenant in Pennsylvania, the property owner must issue a written eviction notice that includes the date by which the tenant must evacuate and the reason he is being evicted. The landlord must file a formal complaint with the justice office, which must be presented to the tenant. A hearing takes place and the judge determines whether eviction is appropriate.
- An evicted tenant has the right to appeal the judge's decision, and must file within 10 days of the initial decision. The tenant may stay in her home during the appeal if she pays three months rent or another agreed upon amount.
