Student Visa and Work Permit UK

The student visaUKcategory allows overseas students to come to study in theUKat various levels, ranging from primary and secondary to post-graduate and vocational, with the ability to work part-time. In order to remain in the uk as a student, you will be required to demonstrate that you have been accepted on a course of study at an organization which is included on the department for innovation, universities and skills register of education and training providers and is at either a publicly-funded institution of further of higher education, a private education institution and an independent fee-paying school. You will also be required to demonstrate that you intend following a recognized, full-time degree course or a full-time course of study at an independent fee-paying school.

Student visa allows you to take part-time or holiday work. However, you may not work for more than 20 hours per week during the term time, do any business nor provide services as a professional sports person or entertainer or work full-time in a permanent job. It is essential that you are able to pay for you course and that you are able to support and accommodate yourself without working beyond the restrictions of the visa.   As a student, your spouse and any of your children under the age of 18 can come to theUKwith you during your studies provided that you can support and accommodate them without assistance from public funds. Your spouse will be allowed to work if you are given permission to stay in theUKfor 12 months or more.

The tier 2 general scheme and business sponsorship replaced the work permit which allows you to work for aUKemployer who will sponsor you to live and work temporarily in theUK. As with work permit scheme, the tier 2 scheme is an employer led process whereby the sponsoring company applies for a visa on behalf of the candidate. A sponsor should only issue aCOSto a migrant if they are satisfied that the migrant is qualified to fulfill the job vacancy. Employers are responsible for ensuring that candidates are eligible and suitable to fill the position being offered and as an organization, they may be subjected to immigration compliance checks with or without prior notice.

To obtain initial approval for the work permit apply for the candidate further leave to remain. Upon expiry of work permit you can obtain extension for permit or transfer if there is to be a change of employer. After working for 5 years in theUK, you can apply for a residency status and in due courseUKcitizenship.
