- Every type of lawsuit has a time limit called the statute of limitations. The statute of limitations is different in each state. The time limit for filing a Georgia accident lawsuit is two years from the date of injury or from the date that the injury was discovered.
- In Georgia, accident victims can be compensated for their injuries even if they were partly to blame for the accident. You are entitled to compensation only if you were less than 50 percent to blame for your accident. This is called modified comparative negligence.
- Georgia drivers are required to carry liability insurance, with a minimum coverage of up to $50,000 for injuries and death, which can be limited to $25,000 per injured person, plus $25,000 for property damage such as damage to a vehicle.
- It is important to understand that any criminal case arising out of your accident will be completely separate from a civil lawsuit. Even those who are not held criminally responsible for an accident can be held civilly liable and be forced to pay for the damages. Being held civilly liable does not result in jail time.
