130 crore consumers! This is what makes India cynosure of all the manufacturers and producers across the world. But a further analysis reveals that the vulnerable position of this poor species in India makes them see double the expected profits. Without any proper legal authority, China successfully exploits India as the most appropriate location to dump all its inferior quality produce. We too pay no heed to the quality and the safety profile of any of the Chinese import and keep ourselves contented only with the price. Consumer Forum is therefore pretty much a necessity in order to help build a demand for quality. There should be no tolerance to cheating, misleading, fraud, misrepresentation and exploitation. Consumer Forum Delhi does seem to be making a noticeable difference both by finding justice and creating awareness among the consumer base in New Delhi.
The forum stands as embodiment of the Consumer Protection Act, 1986 to protect the consumers from any violation of their rights. This quasi judicial authority helps resurrect a legal system which an aggrieved consumer can access in case of being cheated. For a very simplistic procedure, the consumer needs to only file a written application at the Consumer Forum Delhi along with all the evidences in hand. The complaint is duly registered by the sitting clerk against a registration number and a Date on Admission Hearing being issued. The case is presented to the honourable bench to decide on the merit of the case for any further hearing. The notice is subsequently issued to the opposite party on the date of hearing and to bring along their side of story. The bench gives both the parties time and patience during the course up till the date on final hearing. The order is then issued by the consumer forum as binding on the guilty. In most cases the erring manufacturer or the producer is asked to make compensation to the aggrieved party for his losses, injuries, litigation costs and agonies. The court can ask the guilty to make replacement of the defected product or repair the existing one to match the standards. In certain cases the bench has also demanded call-back all of the defected stock from the market for it being disposed off.
The Consumer Forum Delhi also plays its part in generating awareness on consumer rights among the masses. The most recent report by the planning commission reveals that only 36% of the consumers could explain consumer rights and only a fraction of them knew about consumer courts or forums. This makes it imperative for both the government and the NCDRC €National Consumer Disputes Redressal Commission' to take some stern measures on creating awareness about consumer rights and consumer forums. Jaago Grahak Jaago has quite successfully been able to make an impact among the consumer base. A contributory initiative both by the state government and the NCDRC could find a good volume of audiences who could relate the message to their grievances.
