- City or county ordinances and zoning laws dictate any restrictions regarding the height of fences. Some of these height restrictions change depending on whether the fence lands in the rear and front of the house or on the side of the house.
- Homeowners whose properties share a fence also share in the maintenance of the the fence. State statutes outline how disputes about fence ownership will be handled. Statutes also discuss what types of properties fall within the statute's jurisdiction.
- Adverse Possession applies when a homeowner's fence has been erected on the neighboring property for a particular amount of time. The homeowner then acquires the title to that property and the fence can remain intact.
