How to Get Your Arrest Record Expunged in Alabama
- 1). Contact the investigating agency if you were investigated for child abuse but not convicted. The agency has a statutory duty to expunge the information and any corresponding data from its records. If the agency refuses to act, it must provide a written explanation to a judge in the appropriate jurisdiction as to why the information should not be removed.
- 2). Gather your criminal records from the court where the case was tried in the case of inaccurate information. Make a list of all inaccurate information found and provide a narrative explaining the correct situation with supporting documents. If you have been cleared by DNA evidence, you also need to gather all facts related to your conviction and subsequent overturning of that conviction.
- 3). Provide written notification to the Alabama Criminal Information Center, requesting the removal of the information from all criminal agency files. If the agency refuses to issue an expungement, you have 30 days to enter an appeal to the county circuit court.
