How to Change Jobs While Waiting for a Green Card
- 1). Obtain a copy of your application to confirm the date that it was filed. If your application is less that 180 days in processing, you may be unable to change jobs until your green card is approved. If it has been more than 180 days, you are allowed to change jobs with certain restrictions.
- 2). Find a job within the same company or other company that offers the same pay and job duties. During the waiting period for your green card, you are limited to only performing duties identical to or similar to duties that you were hired to perform by your previous or current employer.
- 3). Notify your state's immigration office of your intent to change jobs and supply documentation and valid reasoning why your job change is necessary. Immigration offices hold the right to determine if your new job falls into the set guidelines regarding duties. Your former employer is asked to agree to continue sponsorship before you are approved to change jobs.
